| Summary: | The subject of this diploma thesis deals with the right to a favorable environment, according to the Article 35 of the Charter of the Fundamental Rights and Freedoms. The main aim of this thesis is to describe the essence of this right and then analyze its justiciability according to the legal form of the person to whom the right is granted. The thesis describes the fundamental theoretical approaches towards the subject and analyzes the czech high court's case law regarding the differing possibility of a judicial enforcement of the right to favorable environment for an individual and a legal person (environmental non-governmental organizations) respectively. |
