Summary:碩士 === 國立中正大學 === 會計與法律數位學習碩士在職專班 === 108 === In order to accomplish various tasks, law enforcement officers such as police officer and CGA must stand at the forefront of the situation, so they often face many unpredictable risks. No matter what kind of law enforcement officers, as long as they carry weapons when they are on duty, they must not use it arbitrarily. They have to use weapon according to the legal time that Act of Use of Weapons and Requisite Instruments is ruled, and must follow the principle of proportionality when using to avoid resulting in unimaginable consequences, for example, using weapons may causes the loss of people's property and casualties. And the liability for compensation and the lawsuit will be a mental torture for the officers. Because of the characteristic of the mission, the officers of CGA are considered as judicial police when conducting the investigation duties specified in Article 3 of the Coast Guard Act. Our main mission makes us be different from military, police and civil servants. But there are some services are similar to the police. In view of the recent attacks on the railway police, the law enforcement agencies and the public have begun to pay attention to the types of weapons used by law enforcement officers. Therefore, this article will discuss about the use of weapons by CGA, the relevant laws, compensation mechanisms and the current conduction of the services to make relevant recommendations as a reference for future improvement.
