| Summary: | 碩士 === 國立中正大學 === 犯罪防治碩士在職專班 === 108 === The Sunshine Acts are law on property-declaration by servant, law on political contribution and Lobbying Act. The main purpose of the Sunshine Acts are to promote the politics of clean energy and correct the Ethic Officer to achieve transparency of government integrity. However the law on property-declaration by servant has implemented for over 20 years. The corruption and crimes are still everywhere that are criticized and complained by the reporting obligor. It seems that original law of purpose is contrary to achieve exploring greed and unlawful circumstances.
In order to understand Ethics officers handle the situation of the property reporting Act, the aspects of regulation, institution and execution that have any improvements. This study adopts a qualitative research method to understand the
Ethics officers’s thoughts or beliefs that take in-depth interview on handling the property declarative. There are 6 people in this interview. The conclusion of the following conditional：1. The aspects of regulation：(1) Bring adult child into the scope of property reporting. (2) Including the person has real powers and delates the person has no real power in the scope of the reporting obligor. (3) Reducing the contents of property declaration of "cash, jewellery, antiques, and painting". (4) Increasing the type of penalties and rewarding the honest applicants.(5) Modifying the wind department handle the property declaration dates of public servants, the audit work of the point 12 increase the provision of “correction”.
(6) Deleting the specified reporting provision. (7) Reporting false declarations on purpose should be different in degree. 2. The aspects of institution: (1) The property declaration with the day of tax return and changed to once a year or once every two years. (2) The reporting and discretionary organs shall be separated. (3) Conducting the substantive examination of the property declaration that is only for risk disciplinary officer. 3.The aspects of execution：(1) To expand the authorization or entrust the trusted third party who assist the business solving the problem of manpower shortage. (2)The zero-discrimination policy continue implementing for property declarations that reduce the penalty rate for property declaration obligors. Finally, the property declaration law of public servant, as the research participants says, it should bring a hope sunshine instead of scorching sun.
