碩士 === 元智大學 === 社會暨政策科學學系 === 107 === Since November 4th of 2011, the sexual transaction in Taiwan is regulated by the amended Social Order Maintenance Act, which penalizes sexual transaction outside of sexual transaction zone. This study uses literature review, case study, and in-depth interview to understand the regulation of the sexual transaction since the emendation of the law. While the legal language exonerates sexual transaction within sexual transaction zone in order to provide breathing space for current practitioners, the establishment of a sexual transaction zone in accordance with regulations is however difficult. Few would risk tarnishing the reputation of residential areas they reside in. So far, the feasibility of setting up local sexual transaction zones is very low, and sexual transactions are seriously underground. Therefore, the problems of sexual transaction regulation and crime prevention are tied to informing the general public on human rights and sexual equality, with more considerations on economic, hygienic, and educational factors. The general public ought to become better guided on sexual behavior, learning how to respect the wishes of oneself and others, to avoid rape and sexual harassment, which constitutes a pathway to resolving the problem of unfair treatment towards the sexual transaction.
