Though the conception of a “good life” can be subjective, the satisfaction of basic subsistence with dignity is prerequisite to all peoples’ livelihood, which is also the basis of independence and freedom, regardless of age, gender, socio-economic or ethnic background. The protection of the right to an adequate standard of living was first introduced in the Universal Declaration of Human Rights, which not only served as the main focus of the Declaration and is then further elaborated in the subsequent International Covenant on Economic, Social and Cultural Rights. In the core of the right to an adequate standard of living is the right to an adequate standard of food. Food is essential for all living things, more importantly, the nutrient-intake from food is consumed to provide necessary energy to maintain bodily functions, human well-beings as well as growth, rather than just mere survival. The right to adequate food has more to do with modes of production and issues of distribution than with levels of food production alone. All of these aspects have eventually been clarified and elaborated in 1999 by the Committee on Economic, Social and Cultural Rights’ No. 12 General Comment, as well as by many UN-based organizations and specialized agencies, such as the tremendous accomplishments conducted by the Food and Agriculture Organization of the United Nations and UN Special Rapporteur on the Right to Adequate Food. All of which are referred to and based on by this study as well when interpreting the normative contents of the right to adequate food; not only intends to clarify the intrinsic linkage between environmental protection and the realization of human rights, but also reviews the development of the right to adequate food and the environment in the context of international human rights law and highlights the key elements constituting the current form and factors of the concerned right. 鄧衍森 2019 學位論文 ; thesis 180 en_US |
