The thesis only focuses on the offenders with mental illness who released from psychiatric hospital and tries to find out the risk factors of recidivism. Methods: The objects of this study are inpatients in psychiatric hospital under criminal custodial protection from January 1, 1999 to June 30, 2014. I have tracked the behaviors of the patients for three years since their releases from criminal custodial protection. The collected data includes demographic variable, psychiatric diagnosis, criminal history, treatments during the criminal custodial protection, mental condition after the criminal custodial protection, and any re-offences within 3 years after the custody. Results: 97.5% of patients showed improvement in psychiatric symptoms when they were released from criminal custodial protection. Within three years of release, 50% of released patients were prosecuted with new offences. The male offenders with mental illness who had committed the crime of theft have a higher risk of recidivism (OR=12.179); those who have violated the rules during the custodial period also have a higher crime rate than others. The male offenders who have higher rule-violating frequency (<= 90 days) have a higher risk of recidivism (OR=33.515) than others do. Conclusions: The mental health institutions can treat mental illness and stabilize their symptoms, but there was no evidence of criminal behavior correction. The criminal justice system should establish a forensic psychiatric hospital or other forensic service unit for the male offenders with mental illness or offenders who have the tendency to violate hospital rules.
