Medicine is a science of trail and errors, the resolution of mistakes, development, and progress. However, in the uncertain, irreversible, and restricted medical processes, there is often a huge gap which is caused by the untrusted and intense relationships of medical results between physicians and patients. The such easy way leads to the medical malpractice is a torment for both sides. It is a lose-lose situation. Through the in-depth interviews, this research explores the meaning behind the medical malpractice from the experiences of the physicians and nurses who have been involved in the medical malpractice.To seek the solution which solves the difficulties of medical malpractice, the abilities of dealing the dilemmas and communicating with the family of the patient are discussed in the research. According to the interviews, there are five current difficulties facing in medical malpractice: 1.The phenomenon of criminal vexatious litigation 2.The damaged reputation of doctors and hospitals due to the blaming of the patients through the media 3.The low working identification and self-worth of the medical practitioners 4.The medicine collapsed due to the health insurance system 5.The patients must inform the responsibility and obligation In addition, there are nine suggestions for the medical practitioners to deal with and decrease the damage of the medical malpractice. If the love, forgiveness, communication, and trust replaced the question and anger, the dilemma of the medical malpractice would eventually improve.
