Summary: | 碩士 === 國立中正大學 === 犯罪防治研究所 === 107 === At present, the patterns of adult CBT adopted in Taiwan cover: deferred prosecution via CBT, conditional probation via CBT, probation via protection and supervision, parole via protection supervision and social labor services. Since the implementation of the prosecution in Taiwan in 2002, the scope of application and the applicable objects of CBT have been expanding. It is worthy of further discussion on the current implementation status.
This study first explores the theory of CBT, and analyzes official statistics to understand the implementation system and current situation of CBT in Taiwan. Secondly, through the in-depth interviews with those first-line executives, the researcher will be able to understand the current status of Taiwan's implementation and the difficulties. Third, in response to the predicament faced, it is proposed to improve the current situation of CBT in Taiwan.
This study uses the RE-AIM model commonly used in public policy to design interview outlines, one-on-one in-depth interviews with three first-line executives of CBT. In terms of Reach dimension, the current scope of application is appropriate. If it is necessary to continue to expand, manpower shortage and fund allocation issues should be fully considered while talking about expanding the scope of CBT. In terms of Effectiveness dimension, the implementation of the protection department has the most profound positive impact on the person being treated. In terms of Adoption dimension, the close interaction between the various agencies helps to improve the effectiveness of the implementation of CBT. In terms of Implementation dimension, the current system and the decree are complete, the proportion of cases is reasonable. In terms of Maintenance dimension, the current good system should continue to be implemented, and proposes to improve the screening mechanism, strengthen the prisoner's supervision, protect the job security of the staff, and set up a public halfway home.
Based on the research results, six suggestions were made: 1. the expansion of CBT implementation requires more human resources. 2. The job security of the attending staff should be improved. 3. The feasibility and proportionality principle of CBT orders. 4. Establish a publicly managed mid-course home with high management intensity. 5. In the long run, it is necessary to establish an independent division, which is specifically responsible for the community-based treatment. 6. The policy propaganda business should be planned by the central government with better results.
