| Summary: | 碩士 === 國立雲林科技大學 === 科技法律研究所 === 106 === Justice of the Constitutional Court hadmade the declaration about thearticles in『Assembly and Parade Act』,which specify the urgent and incidental assemblies and demonstrationshave to be prior applied for approval , are unconstitutional ,because of the the Proportionality Principle of Article 23 of the Constitution in 2014.This article discusses the possibleof implementation of prior approval system and reporting systemin『Assembly and Parade Act』in Taiwan with reference to the assembly and process legal system in major democratic countries and spirit of International Bill of Human Right.
To protect human right and offer suggestions of amendment to 『Assembly and Parade Act』,we will discuss the issues of the police order dissolution in the police practice ,which are based on 『Assembly and Parade Act』,relevant act in Taiwan and reference the connotation of assemblies and demonstrationsin major democratic countries.
