Description
Summary:碩士 === 東吳大學 === 法律學系 === 106 === The internet has dramatically changed the way we communicate and how we handle everyday tasks. We send emails, we share documents, we pay bills and we purchase goods by entering our personal details all online and without a second thought. Have you ever stopped to wonder how much personal data you have shared online? Or what happens to that information? This is the question that has been asked and answered by the EU. 25 May 2018 a new European privacy regulation called GDPR has been enforced and permanently changed the way you, as a business, collect, store and use customer data. The European Commission has implemented the General Data Protection Regulation (GDPR) which replaced the old, but obsolete, Data Protection Directive 95/46/EC. It will impose a much stricter regime and sanctions which magnitude may force bankruptcy. It increased dramatically the scope of what is considered personal data while restricting the processing as such. Thus, this work researches how the GDPR will impact the value of data and business proceeding & trade. This study mainly explores the key impacts and the evaluation under the new wave of GDPR, and seeks further solutions. The research is carried out in three Themes: 1. What does the General Data Protection Regulation (GDPR) govern? 2. What are the main differences between the GDPR and the Taiwanese Personal Information Protection Act? 3. The research concerns: (1) GDPR and its impact on cross-border ecommerce logistics. (2) The effect on agreements between enterprises and cloud service providers. (3) The Impact of GDPR on Big Data. (4) GDPR and the Role of Risk Management. (5) Do’s and Don’ts of GDPR Data Security. Data is a valuable currency in this new world. And while GDPR does create challenges and pain for us as businesses, it also creates opportunity. Companies who show they value an individual’s privacy (beyond mere legal compliance), who are transparent about how the data is used, who design and implement new and improved ways of managing customer data throughout its life cycle build deeper trust and retain more loyal customers.
