| Summary: | 碩士 === 國立高雄大學 === 法律學系碩士班 === 106 === Most of the thesis talk about the investigation secrecy are focus on regulating the media or the interaction between the media and the investigative agency. However self-media is the trending right now. People can use the cellphone filming stuff by themselves, and post on the social media. Therefore, the traditional media is not that important than before. So this thesis is focus on applicable object and protectable interest of the investigation secrecy.
The citizen participation in criminal trial procedures is the next big thing in Taiwan, so that the grand jury secrecy in the U.S. can be our reference. Not only the Federal Rules of Criminal Procedure regulates the applicable object, but also U.S. Code, Code of Federal Regulations, U.S. Attorney Manual, Criminal Justice Standards for the Prosecution Function, and Model Rules of Professional Conduct have more specific regulation. And the gag order is another system that we can use in the future. By enacting these new regulation, we might obey the investigation secrecy properly.
