Summary: | 碩士 === 國立臺北大學 === 公共行政暨政策學系 === 106 === The control cultural tradition and Five-Power Constitution in Taiwan is rare in the world. In Taiwan, the control power has a constitutional level. This system is never owned in the Western Separation of Powers. However, when Western countries gradually attach importance to the construction of control power and development of the control system, there was a discussion about retain or revoke of the Control Yuan. Since the creation of Five-Power Constitution, it has only been more than a hundred years, during this period, what changes have occurred in the control power and control system, lead to its despised and ignored by the people. Even in the trend of countries in the world paying more and more attention to the control power and control system, our country intends to abolish the Control Yuan and reset the control power under the legislative power.
Based on this background, this paper will review the history of the control system. The use of historical institutionalism perspective is helpful to interpret the changes in its meaning by considering its inherent qualities, and summarize its development trend, in order to explore the positioning and function of control system, understand the evolution of the control system, exploring its changes and invariance, and looking for the advantages and disadvantages in the development of the control system, and expectation become the basis for the theory and cognitive of the development and adjustment of the future control system.
The findings in the research show that there had two important moments in the evolution of the control system. The Constitutional in 1958 and the second revision of the Constitution in 1992 were major changes in the development of the control system. The first critical juncture Lay the positioning and function of the control system. The second critical juncture has once again changed the positioning of the control system and the nature of the identity of member of the Control Yuan. At the functional level, the second revision of the constitution is the watershed for the development of the core control power and the development of the new control power. Before the second revision of the Constitution, it was the main development period of the core control power of the Control Yuan. After the second revision of the Constitution, the control power of the Control Yuan has not changed. Instead, the new control power of the Control Yuan has sprung up.
Finally, this study shows that the Control Yuan has four major issues that need to be addressed: First, the candidates for the member of the Control Yuan must be able to convince the people. Second, the impeach power and disciplinary power should be strengthen coordination so as to be able to ensure intimidation. Third, more support should be given to the manpower of professional staff. Fourth, marketing should be strengthened to enable the people to understand what the Control Yuan has done.
