Summary:碩士 === 國立臺北大學 === 法律學系一般生組 === 106 === This study focuses on the doctrine on the Stufenbaulehre, also known as the hierarchical structure of the legal order of Hans Kelsen and Adolf Julius Merkl. The first chapter will elaborate the purpose and the method of the present research (chapter 1). Secondly, considering the Stufenbaulehre is one of the central ideas of the Pure Theory of Law, it is necessary to introduce the research orientation of the latter (chapter 2). In addition, since the Austrian researcher Adolf J. Merkl takes the lead in proposing the Stufenbaulehre, it is essential to unveil and evaluate his original conception. (chapter 3). In the fourth part of the study, we will take a glance at how Hans Kelsen, as Merkl’s mentor, adopted and improved Merkl’s doctrine (chapter 4). After making an observation on the birth and development of the Stufenbaulehre, this essay will analyze the structure of the legal order under the R.O.C. Constitution (chapter 5). Finally, the results of the present survey are summarized (Chapter 6).
