It scopes into the legal evaluation and the legal-case categories of Teaching Certificate and Teacher Screening Test involving junior high school and elementary school in Taiwan. The method of this thesis is mainly adopted by way of literacy analysis, document research and legal interpretation methods of the teachers. First, it begins with the reform of the teacher cultivation and studies the fundamental rights of the constitutional and administrative involving in the teacher’s test afterward, which inclusive of working right, equal right, the right to take the exam, the principles of due process, and the principles of trust protection. This thesis classifies the representative types of cases, including the teacher’s qualifications of taking the exam, violations of the rules and regulations, questions and answers. Thus, conducting a discussion on the legal relationship between teachers test-testing, test-takers, and the organizer, also perform the analysis of the legal relationship between teachers of different types (self-administration, several-school joint exam, city or county joint exam). Then, reflect the issues of appropriateness of the parties, and the justice of the administrative law. Finally, conducting the conclusions and the suggestions are the qualifications for the registration, and the responsible institution should clearly state in the general regulations. The content of the examination questions must provide the basis for the document and the disclosure to the candidate, the arrangement of the doubt reaction time should be reasonable and provide the opportunity for the candidate to be present.
