碩士 === 國立政治大學 === 圖書資訊與檔案學研究所 === 106 === In addition to having a refrence for future amendment, this thesis tries to know more about the background and the laws of public access to records in Taiwan and Japan. Using the method of comparative study, this thesis take the four acts in Taiwan and Japan- the management of records, the openness of government information, the protection of personal data and the protection of national secrets- as the research objects. After understanding the articles relative to public access of records in these four acts, this thesis analyzes the differences between Taiwan and Japan by listing the words of articles in both countries’ laws. After comparing and analyzing, there are differences no matter in legal hierarchy, legal formation or the contents and the relations of all acts between Taiwan and Japan. Although both countries have some similar principals or concepts, still many differences exist in detail. What this thesis find out is that there’s need for amending Taiwan’s laws. If Taiwan would try to amend the laws of public access to records in the future, the legislators could consult the laws of Japan. Finally, this thesis hopes to help improving the entire legal system.
