It is extremely important to construct a faultless law system which can be the basis of drug-prevention work. In order to solve this problem efficiently, we resort to the main legal basis, Against Narcotics Act. Offence of making, smuggling, and trafficking drugs , prescribed on Against Narcotics Act Article 4, are regarded as the most serious aspects of this problem. However, Against Narcotics Act has been widely used in practice, but rarely discussed in academia. There are many problems to be solved. On drug research, the vast majority talked about the problem of drug abstention and treatment，in addition, the investigation of drug inspection was the only way of doing research. There are few studies on the practical application of the law differences of opinion. This study seeks to focus on the basic theories of the criminal law to re-evaluate the constitutive essentials of Against Narcotics Act article 4, and to define the nature of drugs making, smuggling, and trafficking. This thesis centers on the offence of making, smuggling, and trafficking drugs brings out the difficulties of the laws, and examines the problems. Finally, the relevant proposals put forward can be more realistic needs.
