The Differing Views of the Judiciary and Internet Media on Judicial Reporting

碩士 === 國立中正大學 === 犯罪防治碩士在職專班 === 106 === Public confidence in the judicial system has long been influenced by media reports, and the widespread use of the internet in the information age has made this influence even more pervasive. However, it has also been found that internet media has a substantial number of errors and biases in reports on judicial decisions. This is an issue that needs to be investigated from the respective perspectives of the media and the judiciary. In this qualitative study semi-structured interviews were used to collect the data, and integrated analysis was used to formulate five themes: discrepancies between judgments and media reports; the media’s understanding of legal issues; judicial confidence and internet media; the communication ability of the court; and the inadequacies of law-related education. The findings indicate that internet media gives primary importance to catchy headlines, timeliness, and click-through rates, at the expense of accuracy. Most of the interviewees were of the opinion that court reporters need not have specialized legal knowledge, but that the content of their reports should be verified as far as possible. It was also found that internet media can have a significant influence on public confidence in the judiciary. Another finding was that the effectiveness of the judiciary in communicating with the media largely depends on the communication skills of is spokespeople. Finally, it was found that most of the interviewees believe that any problems in court reporting need to be seen against the background of the poor state of law-related education prevailing in society.
