碩士 === 東海大學 === 法律學系 === 105 === Insurance with in-kind benefit，refers to the insurance contract in the agreed insurance accident occurred，the insurance company provides the agreed goods or services。In fact，europe and the United States and other insurance systems are relatively advanced countries，implement in-kind insurance has been decades of history，types includes social insurance system and Commercial insurance products。 For the response to the severe challenge from Taiwan's population is aging and manpower of take care structural changed，insurance authorities and legislators are amended personal safety insurance merchandise review should be noted in 2015，added insurance with in-kind benefit chapter to allow insurance industry can sale products of insurance with in-kind benefit，it be excepted that participate in the investment through the insurance industry can relieve stress of the pressure of government's on long-term care and social assistance。 For insurance industry，Insurance with in-kind benefit can bring different chance on business，but there is also quite obstacle to operate this products because of the cost calculation and law risk。So this article will introduce the features of Insurance with in-kind benefit，compare other countries’s and Taiwan with social insurance system and Commercial insurance products of Insurance with in-kind benefit，and discuss the legal dispute and risk。 Finally this article will make a suggestion for amending the law in force，look forward to help the legislation and products promotion of Insurance with in-kind benefit 。
