The first six month of this year, the total amount of the cruise passengers called at Keelung port has grew more than twenty five percentage than last year. The number of the cruise passengers is estimated to reach ninety thousand this year. Although last year the number of the cruise passenger visited Kaohsiung port only twenty thousand, this year it has reached one million. In Taiwan, there is no any standard form of cruise travelling. It makes difficulties when passenger need to take an action for the dead or personal injury and the lost or damage of their personal luggage. Due to the reason above, this study aim to analyze the practical contracts related to cruise travelling to understand the legal relationship of cruise passengers, travel agent and the cruise line company, the obligation of the contract parties and the liability of cruise line and travel agent. Secondly, this study will compare the practical contracts related to cruise travelling with the international convention and the relate laws and regulation of Taiwan and finally, to conclude if the terms of the practical contracts are legitimate. In conclusion, in order to develop the cruise travel market in Taiwan, introducing the standard form of cruise travelling is necessary.
