| Summary: | 碩士 === 南臺科技大學 === 財經法律研究所 === 104 === The enormous potential business in the field of gambling seems to be more and more common all over the world recently, and most of Asian countries have had successful experience of it. However, by the time passing and the world trends, the market of tourism casino is getting saturated, our step is far behind the others. If Taiwan would like to catch it up, we need to evaluate carefully from each aspect as well as learn from the others’ experience.
During the president election of 2008, both candidates of the Nationalist Party and the Democratic Progressive Party made a politics of establishing special area for casino in islands, it turned out only an argument after the election. It was just a mean of political contend to make tourism casino. On January 12th, 2009, Legislative Yuan passed the 3rd reading of Article 10-2 (said as gambling regulation), then it became the legal basis for establishing casino in islands. Followed by the referendum twice in September 2009 and July 2012 in Penghu and Lianjiang respectively, however the two results were opposite. Lianjiang has become the first island that passed the referendum gambling in our country on July 7th, 2012.
This essay will express this matter step by step, from studying of national casino/gambling history, in order to have a brief understanding, then analysis the present regulation identification of casino. While clarifying the applicable law of gambling in our country, we also analysis the gambling rule in terms of construction in islands. We will further compare and study the meaning and result of the two referendums which were significant in our country. Finally, we will discuss the legislative plight we are facing now, giving my own opinion and points of view, wishing to have some good advices for gambling business from the legislative aspect.
