The uses of ICT have been evolving from data search to two-way or multi-way interaction, developing a virtual network civil society. However, in the era of media convergence and citizen journalism, the practices of paste, copy and share can be seen everywhere, giving birth to cases of infringement of copy rights on news reports overwhelmingly, including news aggregator websites using traditional media’s reports, and Internet users or citizen journalists using other people’s photo or video which is protected by copyright law. If the authorization permission is more stressed, the cost of journalists using knowledge will be rising much. Besides, in an anonymous web world, it is so difficult to find the copyright’s owner or get his authorization, and these rules may limit the flow of information. In other words, the higher the intensity of copyright protection, the more rising the cost of expressing public opinion. Regarding the regulation of copyright, in addition to releasing some benefit to encouraging the creation, the welfare of society as a whole cannot be ignored as well. This thesis is aimed to explore how copyright and news communication rights achieve to dynamic balance to some extent with regulation background changing, i.e. regulation subjects of copyright transiting from real into virtual. The evolution of digital technology has got people involved in a more diverse, pluralistic and complex cultural field which is difficult to regulate in advance. The thesis sums up and induces the reasonable limits of fair use by analyzing the case of Google News. The author argues that social websites with integrated services will become the mainstream media platforms, and advises that the regulatory authorities take multi-dimensional institutional reforms instead of single one.
