| Summary: | 碩士 === 國立臺北大學 === 法律學系法律專業組 === 104 === Online shipping becomes more and more popular because its convenience and efficiency. However there’s special risk of online shopping according to its nature. Facing the problems caused by online shopping, what and how consumers could claim for their right, and on the other side, what responsibility should the enterprise keep, would be the questions. In the cases actually happened, if our Consumer Protection Law could thoroughly protect consumer’s right? If not, hope this study could provide some advices for legislator to amend the law. This study based on the method of paper analyzing, and focused on the chose five topics.
In the first chapter I introduced the purposes, methods, and the range of the study. Then talked about the history and characteristics of online shopping cause those may be the reasons why we need the special norms in Consumer Protection Law. The third chapter introduced international law, directive, guideline, etc. For those may be the good reference. The forth chapter is the main content of the study. I chose five topics those occur often or is important of consumer right of the trade made online, includes the right of withdrawal, the standardized contract, the responsibility of prior information, the case of wrong price and the third party payment. At last I made the conclusion about the former five topics with the deficiency of law and my opinion of where there disputations existed.
