碩士 === 國立高雄第一科技大學 === 科技法律研究所 === 104 === The issue has been valued gradually, therefore, the article mainly sorts out the calculation of patent compensatory damages, refers to patent compensatory damages in the United States, shows the opinion of patent compensatory damages by current judicial practice and all the judgements that Intellectual Property Court in R.O.C. has made, then quantifies and analyses the cases that Intellectual Property Court has cast in for damages in order to understand the theory of the calculation of patent compensatory damages and the situation that judicial practice works in R.O.C. Last, the article proposes the suggestion of amendment and application of legislature in patent compensatory damages in R.O.C.
