Summary:碩士 === 國防大學 === 法律學系 === 104 === Because of the nature of military mission, soldiers have to stay in high-risk environment frequently. In addition to traditional warfare training, soldiers also need to perform new patterns of military tasks like disaster rescue and relief, epidemic prevention and cure, road tree clean and so on, since country policy adjustments and changes of the times. These kinds of service are dangerous, but the execution rules, protective measures and equipment for soldiers are incomplete. For this reason, there are many soldiers get hurt while they are performing the task. Therefore, the main purpose of this study is to discuss whether a country should give soldiers relative protection and care according to their position and feature, and whether the existing protection rules should be improved. Besides, in military casualties, can soldiers take pension, insurance, relief, and request state compensation at the same time? Can these payments be deducted? We hope this research can provide soldiers a theoretical basis when asking state compensation in military casualties
