The probation system originated from the kind-hearted people’s good deeds in the West Country. The key persons, the probation officers of the District Prosecutors Office, are the governmental representative.
The Taiwan After-Care Association with local service characteristics, began with spontaneous good deeds by popular in early day, is a representative of nonprofit organization.
The Ministry of Justice Organization Act expressly provide that the Department of Prevention, Rehabilitation and Protection tasks include planning and directing matters concerning adult probation and post-release projects.
From the organization and the responsibility of positions point of view, the Department of Prevention, Rehabilitation and Protection carries out the judicial protection task.
Taiwan after-care Association has been established since 1946. It lasts for 70 years long. The District prosecutors office, plays an important role in out-of-prisoner’s resocialisieren and crime prevention as well. Taiwan After-care Association and District prosecutors office creates a flexible unusual mechanism and a close partnership and work hard on crime prevention. The government also continues to implement a lot of policies on judicial protection.
This paper studied the partnership between District Prosecutors Office and After-Care Association, which employed example analysis on the policy agreement, administrative operations, Resource Sharing and association trust.
This study is based on the survey of the probation officers of 19 district prosecutors offices in Taiwan and Fujian area, Taiwan and Fujian province (Taiwan and Fujian area ) A total of 19 District Court, public prosecutor's Office (District prosecutors Office) the probation officer (Probation Officer) Mailed questionnaire survey, issue 213 questionnaires recovered 146 ; as well as Taiwan and Fujian province (Taiwan and Fujian Area) a total of 19 full-time personnel of the rehabilitation protected Branch issued a total of 40 questionnaires recovered 31 questionnaire a total of 177 . Public Prosecutor's Office in the District Court (District prosecutors Office) with regeneration protection (Taiwan after-care Association) Relevant guidance policy common knowledge, administrative operations, resource sharing, the degree of impact of organizational trust.
Findings are as follows:
The relatuonships of the District Court, public prosecutor's Office (District prosecutors Office) and protection of rehabilitation (After-care Association) Policy showed a lack of unanimity.
Second, it is a crucial factor on the administrative operations to maintain the equality of the Partnership.
Third, the protection of offenders (After-care Association) resource sharing is most likely relied on the District Court, the public prosecutor's Office (District prosecutors Office).
Four, the organization lacks of mutual trust.
Five, it is a essential factor to consider the length of service career.
This study presents several proposals as the followings:
First, on the aspect of reciprocal policy : to enhance the public and private sectors professional policy advice and provide specific technical expertise assistance.
Second, on the aspext of administrative function: to build up the strength of mutual communication and coordination.
Third, on the aspect of resource sharing: to augment the flow of resources and assistance functions.
Fourth, on the aspext of organizational trust: to establish interactive relationships and enhance the trust of collaborations.
