碩士 === 國立成功大學 === 法律學系 === 104 === Intangible Cultural Heritage can be classified into “Technology” and “Craft” two parts, and when compared to Tangible Cultural Heritage which possesses space, form and structure, the Intangible Cultural Heritage is mainly based on history and wisdom of life. In other words, the Intangible Cultural will change due to time and society evolvement. However, in recent years, globalization and industrial development have largely changed our society and it caused Intangible Cultural Heritage disappeared in a drastic speed. For that reason, this article is hopefully to construct a solid base for protection of Intangible Cultural Heritage which is according to the regulations in the constitution, a base which is derived from cultural fundamental right. So that we can review the system of protection of Intangible Cultural Heritage and find the deficiency in the system─ lack of an central authority and the system of certification. Finally, this article will provide some concrete suggestions on protection of Intangible Cultural Heritage.
