碩士 === 銘傳大學 === 社會與安全管理學系兩岸關係與安全管理碩士在職專班 === 104 === Since it declared Martial Law ended, cross-strait people has communicated and interacted to each other for years, implying the increase of possibility and necessity of mutual intermarry. In light of the increasingly serious cases of illegal activities, illegal work or prostitution of people from mainland China in the name of marriage, which jeopardizes the safety of society and nation, it has implemented interview system for people who come from mainland China in the name of marriage since 2004. In order to judge whether the marriage is real or not, it makes comparisons on the mutual parties’ descriptions about the process of getting acquainted with each other or the situation of interaction for tightening control on the examination for Taiwan residence application of mainland spouse. This study aims to explore whether it has deficiency or not on the current prevention mechanism against false marriage of mainland spouse from an overall perspective. Further, it referred to relevant theories and literatures for formulating the improvement and reinforcement measure on visiting and interview mechanisms. It adopted appropriate corresponding countermeasures by means of Operational Risk Management Integration Tools to make an inductive analysis on the risk factor of failure on preventing false marriage of mainland spouse in order to take effect with its natural mechanism, promote the efficiency as well as lower the incidence of Taiwan residence application of mainland spouse due to false marriage. In addition, concerning the relevant literatures for management mechanisms on Taiwan residence of mainland spouse, it summarized risk factors for 66 categories at primary stage to make the expert hazard identification analysis with Operational Risk Management Integration Tools(ORMIT) as hazard identification tool. It obtained 21 items of main hazardous sources via in-depth evaluation and determined the risk level of risk factor by means of assessment of expert. Among these, it ranked the extremely high risk level on “investigation restricted by law”,” providing fake/modified untrue information” or “collecting previous questions in interviews as a long-term base and making the guideline adaptation. In conclusion, it proposed the suggestions for relevant authorities in terms of lowering risk in practical operations from three perspectives of policy, regulation and implementation as follows: 1.Policy Perspective: complementary measures to build up inquiry window as an office in mainland China and shorten the requirement of period for obtaining ID card of mainland spouse 2.Regulation Perspective：To continuously improve relevant regulation and order, operational regulation, hold periodical education training, professional seminar as well as increase professional manpower as supplementary for visiting. 3.Implementation Perspective: To carry out the visiting and interview mechanism, change questions for interview, strengthen the skill of interview, contact with judicial and policing authorities, take the initiative to combat the illegality and make operational risk assessment periodically for the purpose of prevention the false marriage of mainland spouse for Taiwan residence application.
