This is the issue that a nation based on human rights shall pay attention to.
The study, from paper analysis of the United Nations Charter, International Labor Organization, Labor Standards Act, Employment Service Act, and safeguard for foreign workers, concludes human rights situation of foreign workers, and regulations about salary and treatment for foreign workers. Also from the point of view of equal treatment, searches out current status of human rights protection for foreign worers, relevant regulations & policies and the working conditions of Vietnamese blue-collar workers in manufacturing industry.
Vietnamese labors working in manufacturing industry apply to Labor Standards Act, and the Act is to maintain and promote the safety and health of workers by preventing industrial accidents and creating comfortable working environment through establishing standards on occupational safety and health and clarifying where the responsibility lies. Labor Standards Act, Article 25 expressly stipulated that an employer shall under no condition discriminate between the sexes in the payment of wages. Worker shall receive equal wages for equal work of equal efficiency. The Act also stipulated that a worker shall be permitted to have a break for at least thirty minutes after having worked for four continuous hours & a worker shall have at least one regular day off in every seven days & overtime wages shall be paid according to provisions. And these provisions are the foundation for the study.
The study found racial discrimination still exists, hope in practice there’s an equal comunication platform for foreign workers, employers and labor brokers whereby all the disagreements based on different positions could be communicated and coordinated in order to have the opportunity to reach consensus. And also believe that it helps people have a deeper understanding aboutf foreign workers, thus or even reduce foreign workers having motivation to escape, therefore, employers need not to take the risk of paying penalty for managering foreign workers.
Regarding to maintenance of human rights for foreign workers, suggests the Government to strengthen advocacy of human rights, and to lift the restiction of non changing employers for foreign workers in the manufacturing industry, and to give rewards such as extending working time-limit for foreign workers having excellent performance during working period in Taiwan.
