This Research will first study from International Bill of Human Rights, legal rules in our country and others states’ experience to developing drop out students theory and legal system, discussing with drop out education policy practice, the related rule of law, the implementation and effectiveness of the actual situation, after first, research would study on how to protect the rights to learning and education by policy and legal system. The purposes of this research are: 1. To construct a base on protect the rights to learning and education legal system. 2. To integrate dro out students center educational legal system research. 3. To generalize and study the basis of drop out students educational policy an legal rule. 4. To inquiry the practice of drop out prevention and back to school guidance then to provide policy planning and legal modifications. The results of research are: protect the rights to learning and education should be the center of drop out education legal system; drop out education policy legal system not only protect the rights to learning and education but also thinking more positive learning freedom; base on fundamental education to think about drop out prevention and back to school on educational opportunity equality and there should have alternative education, drop out students counseling be more flexible and free. There are suggestion: protect the rights to education should not only by compulsy educational thinking; the definition of drop out and the legal rule should be more clarify; the administrative appeal right of drop out students should be consider; alternative educational facilities and counseling should flexible, whole life learning should be the basic of drop out students policy and legal system planning.
