Summary:碩士 === 國立中興大學 === 法律學系科技法律碩士班 === 103 === The Police play a double role as administrative and judicial police in maintaining social order and promoting the public interest. As the administrative police, police officers execute the criminal investigation power in accordance with the Police Power Exercise Act for the sake of collecting evidence and preventing the hazards of felonious and organized crime. The investigators of the Ministry of Justice Investigation Bureau (MJIB), on the other hand, assuming the responsibilities for safeguarding national security and preventing major crime as intelligence officer as well as judicial police, do not have a legal basis like the Police Power Exercise Act. Discussions are needed on how MJIB investigators collect crime evidence effectively while performing the role of intelligence officers without a proper legal basis. Therefore, this paper studies the practice and legality of MJIB investigator''s authority under the existing law.
