| Summary: | 碩士 === 佛光大學 === 社會學系 === 103 === July 3, 2013, a compulsory service man, corporal Hung Jun-chou, who would leave the army in one week had been put in confinement for the breaking rules by bringing a cell phone with camera, which should be strictly forbidden in the barracks. During the hart fitness exercise on hot summer’s day in confinement, corporal Hung fell down for the heat and exhausting. After emergency CPR and sent to hospital urgently, corporal Hung still died at night that day. The event provoked great political and social incidence. People angered for the sudden death of corporal Hung, believed that the reason caused Hung’s death should involved some kind of conspiracy, and Hung should have been mistreated during confinement, his superior NCOs were to be a suspect of murdering corporal Hung. They thought the military authority concealed the shameful facts on purpose. The public demanded government gave them the truth, and the socalled “Movement Union 1985” called out people for walking on the street and protesting, and there were great social movement against the military authority and the government. This resulted the prime minister of defense resigned, and Ministry of defense agreed to transfer the Military Jurisdiction to the ordinary law system. Thus, this case should put in the ordinary civil court for trial instead of in military law system.
The trial took place in the Taoyuan district court as the public wished. The final judgment announced on the day of March 3, 2014. The judges considered the whole event occurred out of many administrative negligence, and defendants had no intension to take live of corporal Hung. Thus all defendants of this case were sentenced minor prison term. The result aroused another public anger, people were unwilling to accept such a judgment.
It is an interesting to compare the court judgment based on evidences with the public emotionally subjective expectations. Such unbalanced phenomenon occurred from the misunderstanding of the soldiers and the military society by common people. The army has it’s own value system. In order to fight the cruel war, soldiers must possess some kind of characters. These characters differ from those in common people. Such as Communal Life, Hierarchy and Discipline, they are the premium elements which comprise the military society. This leads to two kind of thinking system, one of the common persons, one of the military, and these two systems reject each other. That’s the major reason makes people interpret one event from two different view of points. One from common person, one from military service men.
