According to Article 2 of the model provisions, the policyholder is the “ group ”, and the members of the group are insureds. In other words, group insurance is entered into by third party.
There are several problems to be solved: First, if the policyholder has no insurable interest in the insured, shall group insurance be void? Second, Article 105 of the law of insurance should get the regulation of written consents of the assured, is it applicable in the group insurance? Third, Who has the right to designate or change beneficiary of the group insurance? Fourth, who is the policyholder of the group insurance? And how can we identify the insurable interest of the policyholder and the insured?
In addition, the qualifications of the assured of group insurance limit the clause, termination provision, conversion provision, exception clause and incontestability clause. All have a need that is reexamined again.
Enterprises should develop background and function specially with the group insurance, combine welfare programs of staff, push the function of the group insurance to be largest, feedback society and country. Perhaps the culture of every country is different, the enterprises of our country can't fully understand function and importance of the group insurance.
