In this virtual community which has developed a lot of crime. This study is focused on exploring one kind of the cyberbullying; ''Internet Defamation Cases'', not only discuss the threshold and principles of the prosecution on such cases, but also explore the related future trends of the legislative policy. The methods of this thesis are empirical law, including case studying and expert interviews. The results are as following: (1) The five prosecution threshold and principles of Internet defamation cases; (2) The inspection standards between the freedom of speech and the actual malice; (3) The inevitable trend of the decriminalization of defamation.
