碩士 === 亞洲大學 === 資訊工程學系碩士在職專班 === 102 === In recent years, there has been a phenomenon concerning “the gap between learning and application” as well as “the imbalance between supply and demand” in our human resource training, which affects the whole society and the economic development, due to the rapid social change, higher education excessive expansion, and the low birthrate. Therefore, the White Paper on cultivation of education talent was proposed by the Ministry of Education in the end of 2013. The vision of cultivating diverse talents and creating a happy and prosperous society was expected to achieve through this high-quality education plan. The implementation of OCW (Open Course Ware) has not only received the worldwide attention but also effectively enhanced the education quality and the learning effect as well. However, the contents and teaching materials of OCW shown in the digital form are converted from those original teaching matters. In this case, the types of copyrights on the digital materials as OCW contents are more subject to much controversy and more diverse and complicated than those on the traditional teaching matters. This thesis first introduced several cases happening in the past on digital teaching materials along with the controversial types of copyrights, and then analyzed the range on the copyright for its “fair use” within the occurrence of teachers’ teaching practice and also judged what kind of criteria it is as well in accordance with the copyright laws. Finally, the measures to the teaching practice are also presented with a view to providing guidelines for teachers to follow and, furthermore, offering the suggestions on amending the present Copyright Law to make it better fit of current teaching practice.
