| Summary: | 碩士 === 南台科技大學 === 財經法律研究所 === 102 === The Labor Safety and Health Act of our country is an important cornerstone to protect labor safety and health from occupational hazards. Along with the change of industrial structure in our country, labors are facing hazards of new emerging diseases like
overwork, musculoskeletal disorders, etc.. Meanwhile, as development of new process and new technology, labors are gradually exposing to the risks arising in emerging industries, showing that our current Labor Safety and Health Law is unable to bear the impact of industrial environmental changes. To prevent occupational hazards and
protect labors' safety and health, in addition to the implementation of necessary labor inspection, the Labor Department should also consider the domestic operating environment trends, labor rights protection and the existing infrastructure of labor safety
and health, and actively complete the draft of Labor Safety and Health Law which was completed Three Reading Program by legislature on June 18, 2013 and announced by the President on July 3 in the same year. This study aims to investigate the legislation
spirit of amending Labor Safety and Health Law to Occupational Safety and Health Act,hoping to analyze our national short-range strategy on promoting Occupational Safety and Health Act in the future, with the data collected from the viewpoints of the
interviewees who possess professional knowledge of safety and health in industries,governments and academia in Tainan City through qualitative individual in-depth interviews. This paper believes that, first, after the implementation of Occupational Safety and Health Law which covers all industries, the government disaster advisory group should include the industries which are not listed in the instructions of Labor Safety and Health Law as priority advising object and provide the middle and small-sized enterprises facilities and appliances subsidy messages to improve their safety and health.second, for the provisions that the interviewees doubt about in this study (like Item 12, Paragraph 1 of Article 6 in ccupational Safety and Health Act),the Ministry of Labor or local authorities should organize job hazard prevention advocacy or release related operational instruction and key points as norms for the institutions to comply with, thus eliminating their doubts.
