| Summary: | 碩士 === 東吳大學 === 法律學系 === 102 === Marriage is an important social system since the development of human civilization. So far, the divorce rates both of Taiwan and China are still high. After divorcing, not only the identity and property are changed, but also the dependent rights of minor children of the marriage is also affected. So divorce is not just a personal affair, but also an important issue about the security and stability of the country and society. The start, end of marriage, the protection of the dependents rights of minor children after their parents' divorce, and the properties after the divorce are fairly liquidated, correctly segmented, and continue to be parents after divorce, and to meet the child successfully are important issues, and also the important topics of this study.
In this study, the topic is to discuss the impact of divorce on family members under the legal framework of cross-strait marriages. This study is based on arranging the studies, journals, papers and other literature. The first chapter , "Introduction", is the introduction of this study. Chapter II, "The Laws and Regulations of Cross-strait Marriage", is to introduce the method and requirements of divorce and judged divorce. Chapter III "The Effectiveness of the Identity of Divorce between the Marriage Laws Cross-strait ", is to describes the relationship between parents and children after divorce. Chapter IV "The Effectiveness on the Property after Divorce between the Marriage Law Cross-strait ", this chapter is the key part of this study. Depending on the 2001 and current marriage law of the mainland China to discuss the property regulation of husband and wife and the impact of property after divorce. Chapter Five, "The Problems and Solutions of Cross-strait Marriage Law of Divorce", is to summarizes the problems and to propose solutions of cross-strait divorce. Chapter VI "Conclusion", is to review and to consider the purpose of current divorce system should be building marriage relationships depending on couple who love each other and willing to build a happy family.
