碩士 === 東吳大學 === 法律學系 === 102 === The genetic test presently taken domestically is generally used on pre-pregnancy, prenatal screening, helping the clinical diagnosis and the early diagnosis, and predicting drug responses. Thus, in domestic research papers and related references about Prenatal genetic test, which is only discussed in the research of “Preimplantation Genetic Diagnosis（PGD）”and “Newborn screening” , is very rarely mentioned of “Prenatal genetic test during fetal period”. Data that emphasis only on prenatal genetic test during fetal period is also hardly found. In order to fill this vacancy and to have an overall investigation and discussion on prenatal genetic test, this research takes oversea prenatal genetic test regulation, guidelines, and declaration as references, combines the related domestic Act, regulations, and guidelines, coordinates and analyses the differences between the two, and takes the local cases and news that happened recently as illustration, to make the prenatal genetic test during fetal period can be discussed and studied comprehensively and widely. Through this research, we can have a complete image of the prenatal genetic test that domestically taken presently. This research also suggests how the related regulation and laws should coordinate to make the system more complete. In addition, it advices the country to amend the related law which already taken in Swiss and Germany as soon as possible. Thus, pregnant women and their fetuses can be protected by the law more completely while taking the prenatal genetic test and the medical people can pay more attention to this issue. The medical people must aware of the existing danger from the begin when they are doing the pre-pregnancy consultation, prenatal test, and the whole laboring process. While providing professional completed advises, the medical people should also make efforts to reach the safety expectation of pregnant women, their babies and their families and protect the right of people taking tests. In this way, this regulation can help the advancement of medical industry of this country.
