Summary: | 碩士 === 國立臺東大學 === 公共與文化事務學系區域政策與發展研究碩士班 === 102 === Due to the social and policy changes, there are the conflicts about aboriginal reserves in Taitung’s Kinchen Mountain between Jinfeng and Taimali. This argument results from the policy of Quasi-conservation Area Rules imposed during the Japanese-ruled period. The KMT government followed up the plan but turned the reserves to nationalize. It was lack of the technology to measure the boundary correctly at that time. The government settled down the veterans and victims of natural disasters at Kinchen Mountain since 1950. The governors of townships dispute the jurisdiction of the reserves because of election. This paper would discuss the issue by across boundary governance theories.
This study employed interviews with the diverse stakeholders to explore the use and management of aboriginal reserves at Kinchen Mountain area. The findings indicated that the key point is central government who policy planning was inconsistent. There are no shared interests between both sides. The Taitung government attempts to construct the tourism and leisure area at Kinchen Mountain. It is restricted by the finance and the controversy laws from central government. Moreover, racial sensitivity hinders the mode of across-boundary cooperation. The central government should integrate the two sides from a higher status as well as from a neutral perspective.
However, it remains unclear as to the two towns’ legal authorities and functions as to across-boundary governance. In addition, owing to the limits of relevant policies and regulations, the county government is not able to provide any assistance. The key of the problem lies in the malfunction and inconsistent policies of the central government, and thus across- boundary strategies offer less mode of handling to the central government.
This study suggests that the central government should decentralize the authority of decision making and establish an across-department special committee to take the accountability, or set up a broad-based governmental organization to tackle such land disputes. Furthermore, assisting regions to foster their featured industries and create a triple wins situation.
