| Summary: | 碩士 === 國立臺灣海洋大學 === 海洋事務與資源管理研究所 === 102 === Surrounded by sea, Taiwan is located at the edge of the Asian continental shelf, having the superior geographical position. Due to the influence by Kuroshio, ocean currents and climate of surrounding waters, excellent fishing ground has been forming in northern three islands waters area, attracting many boats gathered from Taiwan and Chinese mainland, which making the fishing order is much more complex than other fishing ground and more incline to conflict. Fishery resources have been presented signs of recession in the northern three islands waters, which is need to protect urgently. At the same time, illegal fishing form Chinese mainland fishing boats cross the border illegally is seriously affecting the fishing rights of Taiwan fishermen. The new amendment of The Relationship between Taiwan and Mainland China Regulations gives coast guard authorities penalty authority to punish Chinese mainland’s fishing boats cross the border illegally. Coast Guard authorities executed fisheries law in the northern seas, is facing the five difficulties including “difficulty of law enforcement is higher than ever”, “long distant of law enforcement”, “controversy on the overlapping economic zone between Taiwan-Japan and Taiwan - Philippines”,”aging law-enforcement stuffs and generations problem inner the coast guard authorities” and “air law enforcement power failed to combine law enforcement at sea vessels”. In order to improve the law enforcement efficiency of coast guard authorities ,this study suggests five specific recommendations, comparing the sea law enforcement agencies of Japan and China, and combining comprehensive analysis of practical findings and datas, including establish coordination and contact mechanism with Chinese mainland, review and evalute “New Construction Project of Peng Jiayu Forward Bases” plan, timely deployment of large frigates to support the fisheries law enforcement of northern three Islands seas, set up exclusive coast guard personnel training school and enhance the joint law enforcement power of sea and air. Beside that, on the law aspect, establishment of marine department in charge of maritime affairs and “promulgate the basic act on ocean policy” are as for future development standards of marine affairs.
