The interview system for the Chinese spouse arrived in Taiwan---A case study of Taoyuan county

碩士 === 開南大學 === 觀光運輸學院碩士在職專班 === 102 === After the government decided to allow the Mainland spouses to enter Taiwan in 1993, there have been cases of fake marriages between spouses of Mainland and Taiwan, and these marriages have been used as a way to engage in illegal activities. In worse cases, these spouses are the victims of human trafficking. Therefore, the government has placed an interview system when the Mainland spouses apply for immigration to Taiwan in order to stop the illegal immigrants. This is to avoid the endangerment of national security and public interest, and at the same time to protect the legal Mainland spouses. According to 「relationship between peoples of the Taiwan area and the Mainland area requlations」, the interview system of 「Administrative measures on the mainland people applying for interviews in Taiwan」was creeated. Based on the experiences, the interview management system has been continuously revised and improved. As a result, the structure and the contents have been slowly perfected over the years. This interview system for the Mainland spouses entering Taiwan has proved to be effective against the use of fake marriages for illegal immigrants and human trafficking organizations. Therefore, the existence of the interview system is necessary; however, the current system can be improved by not only the perfection of the system itself and the sophisticated skills of the interviewees, but the creation of the best balance between the national security and human rights. This research reveals that the immigration officers are experienced and highly concerned on the interviewing system, the interviewing system has an optimistic impact in avoiding the false-marriage, with the lack of the execution of interview may affect the whole efficiency of the interview. What’s more, the pro-interview for the interviewee can not be executed thoroughly, and the law authorization plus the interview system are regulated under. In conclusion, this research pose some of the suggestions, which are to strengthen the checking system before and after the Chinese spouse immigrated into Taiwan, second is the discuss the possibility of setting a interview spot in mainland china, the third is to establish a data checking system of the two-side marriage, the fourth is the build a complete interviewing system to avoid the false marriage or the eliminate the frequency of applying for marriage interview. With the above mention we hope to provide a reference for amendment of the law.
