Until the early 20th century, the rise of gender equality and the feminist act make countries begin to develop sexual harassment prevention related regulations. In this study, the sexual harassment prevention and legal norms of social welfare foreign labor in workplace as the subject to explore foreign legal literature and systems, and to discuss the implementation of the existing laws and legal systems of Taiwan. The social welfare foreign labors’ working character is as household service. When it comes to the workplace sexual harassment prevention, often due to workplace identification, workplace environment limitation, evidence of sexual harassment collect difficulties, and etc, the establish of sexual harassment case of social welfare foreign labor in the workplace is not easy. Moreover, the most employers employ less than Sexual Harassment Prevention and implementation’s accordance of the employment number, which make more difficult of sexual harassment prevention of social welfare foreign labor in the workplace. The result of the study suggests:First, the legislature of government shall make the completion of the Family Services Act, in order to demand the duty of employers to prevent sexual harassment in workplace. The second, establishing complete systems to visit, arrange emergency placement, replace employers, and to have multiple communications and supports systems for social welfare class foreign labors. The third, establishing workplace sexual harassment prevention training system for employer to make them realize the importance of prevention of sexual harassment. Furthermore, implementation of Sexual Harassment Prevention is an important indicator of the workplace gender equality. The current legal system of Taiwan still needs to make progress of it. There’s hope to the future that the government will dedicate to raise the public awareness of sexual harassment prevention for the social welfare foreign labors and also workplace gender equality. 郭俊麟 102 學位論文 ; thesis 128 zh-TW
