| Summary: | 碩士 === 世新大學 === 行政管理學研究所(含博、碩專班) === 101 === As usual, the most studies on exercise of the discretion take the police as major subjects, however, with the change of time and space, most administrative organs hold a certain discretion by legal authorization, thus this study is expected to learn the situation of the roadside inspectors exercising their discretion through discussing the their discretion.
This study aims at three variables of personal subjective factor, department performance factor and external pressure factor respectively to conduct the discussion through literature analysis and depth interview, which is expected to learn whether the inspectors will be affected by the three variables when they exercise their discretion, and discuss the difficulties and solutions for the inspectors in current road check services.
This study finds that for the personal subjective factor and the external environment pressure factor, the inspectors approximately conform to the theory. Just only for the department performance factor, it is not the main cause of affecting the discretion, moreover, it is really lack of education and training for the inspectors, and reasons include insufficient times, practical training shortage and the increasing change of violation forms, and the inspectors believe the manpower shortage and insufficient security system are the biggest difficulties of taking the road check service at present. Finally, this study proposes the policy and suggestion, which are respectively to review the road check rewards and penalties system of s, set the proper road check rewards and penalties system, focus on the the education and training of the inspectors, so as to make the proper training and budget to increase the insurance of road check for inspectors.
