碩士 === 東吳大學 === 法律學系 === 101 === Summary According to “Communications Protection and Surveillance Law”, telecommunication carriers bear the assisting obligations in communication surveillance. The structure of this thesis that focus on the telecommunication carriers’ legal obligations is as follows: Chapter I illustrates the motivations, methods and realm of this thesis. Chapter II illustrates the concept of communication surveillance and telecommunication carriers. Chapter III illustrates the intrusion on constitutional rights（including the freedom of business operators and the property right）by telecommunication carriers’ assisting obligations in communication surveillance. Chapter IV illustrates the Communications Protection And Surveillance Law in Taiwan and the existing standard laws（focus on CALEA）in United States from a comparative lawviewpoint. Chapter V provides suggestions for practical work. Chapter Ⅵ, conclusions.
