For the people&;apos;s right of residence, property rights, and the right to life can be ensured, the Ministry of the Interior enacted the regulation "land expropriation must be executed for the Public Interest &; Necessity Assessment” in January 8, 2011. How to act for ensuring the rights of stakeholders triggers the motivation for my study. The study area is the agricultural district in Kaohsiung Fengshan. The purpose of this study were to investigate whether Public Interest &; Necessity Assessment can be sure protect people’s rights and interests, and propose correct suggestion. The study review the theory of Regulation, Regime, Transaction Cost, Rational Choice and Social Impact Assessment and using fieldwork, questionnaire interviews and explanation meeting. Then the rights of land owners are discussed and analysed to find out their opinion of rights protection and concerning topics. The results show that more than 85% land owners are non-farming for a living. They expect to increase the land value and support the zone expropriation. The main point of contention is that the land to reclaim the proportion, the location of the land distribution and vulnerable households with illegal factories placement and migration. The conclusions of my study are Public Interest and Necessity Assessment indeed could promote the protection of the interests of the land owners and propose amendments to guidelines. To the other stakeholders, we still consider and protect their rights and resettlement.
