Summary: | 碩士 === 國立臺灣大學 === 政治學研究所 === 101 === Based on the Grand Justices Council adjudication in 2009, Social Order Maintenance Act violated the principle of equality that punishes only prostitutes rather than the sex buyers. The law should be revised within two years. This research explores the policy process of the law amendment between November 2009 and November 2011 in Taiwan. Since the issue of sex trade legality has many dimensions of consideration, which include social norms, morality and traditional values, the support and opposing sides of sex trade mobilized to influence the policy results.
The research finds that the sex trade policy during this period, changed like a pendulum, was strongly influenced by news media and election The general public surveyed support sex trade as a business(69%)and agree with the establishment of a designated sex trade area(more than 70%). After the revision of Social Order Maintenance Act, the sex trade management is transformed from general prohibition of sex trade to conditionally legalized business. It is concluded that Taiwan sex trade policy was critically changed by Grand Justices Council that opened the door for legal sex trade.
