The purposes of this paper are that on the basic of the principle of the welfare state to view social insurance, and to prove the national pension in Taiwan, and then according to the Three-Pillar Model of the World Bank''s theory prove the national pension that how it works to the elder and to their economic security, and the last, the most important of all, that to discuss the administrative remedy system of the national pension, not least the dispute review procedure and the proceedings procedure, to suggest that how to ensure the people''s right of the national pension, and how to make the principle of the welfare state''s conception integrating into the administrative remedy system of the national pension. The conclusion of this paper, all things considered, dealing with the administrative remedy system of the national pension between the common Administrative remedies is contrary to the principle of equality. Because of the social insurance under the social state principle is different from the common administrative act, so that it is necessary to establish a special administrative remedy system for people to using with the proceedings procedure of the national pension. Not only in order to protect the insured of the national pension, but also to promote their rights of the national pension.
