The measures of patent portfolio and litigation patent portfolio adopted from Parchomovsky and Wagner (2005) are the size variable measured by the number of patent and the diversity variable measured by the number of International Patent Classification. Besides, we also compared the similarities and differences between technology types of the patent portfolio and litigation patent portfolio by using patent IPC analysis. The results show that except HTC, the other four companies- the patent portfolio and the litigation patent portfolio in each Apple, Nokia, Motorola Mobility and Samsung have the technology type have the similar technology types: the technology type in Apple are G06F009 (software application management), G06F003 (multi-touch), 1402 (designs) ; in Nokia Corporation and Motorola Mobility are H04Q007 and H04M001; in Samsung are H04M001(handheld electronic device), H04Q007(wireless communication technology), G06F003 (multi-touch). However, in HTC the technology type between patent portfolio and the litigation patent portfolio is different and the litigation patent mainly licensed from the other companies. The company used its patent litigation with a particular type of technology types, different enterprises patent litigation is not the same type of technology, and focus on the development of different types of technology companies has not the same type. Enterprises used patent to litigate with an average age of 12.56. In addition, the study also found that companies in the construction process of the patent portfolio, companies must obtain outside of company to complement the company's existing patent portfolio, thus enhancing litigation patent portfolio to enhance the competitive forces. The findings also show that the type of technology enterprises mainly litigation consistent with the technology type of inside R&;D to strengthen patent portfolio. This study suggests that corporate patent portfolio patent strategy should be based on long-term perspectives, the patent portfolio can be achieved through external technology to strengthen.
