A Study of Law and Management Models for Troubles between Labor and Capital
─An Example of Tainan City (2002-2010)
Both labor and capital are important factors which promote economic development. If labor and capital can cooperate well, this can stabilize the society and help the economic development. However, troubles between labor and capital are inevitable. If the troubles are not solved appropriately, they might cause a tension between labor and capital and a chaotic situation of the society. Furthermore, this might hinder the development of economy. Therefore, how to deal with troubles between labor and capital is an important issue for the government, and it is the topic of this research.
As economy develops, the number of troubles between labor and capital increases and the quality of troubles becomes more complicated. Confronting these troubles, the government needs to develop appropriate policies to deal with them. Taiwan can learn from other countries about legislation and policy concerning this type of problems. For example, Taiwan could establish the constitutional labor right, add legitimacy to dispute, and pursue other ways to solve dispute, which can protect the rights of both labor and capital and keep the concordance between them. Those methods are worth considering and studying. If the models to cope with the troubles between labor and capital are appropriate, they can improve rights of labor, enhance the relationship between labor and capital, and
promote the development of economy.
In recent years, the Taiwanese government has been amending three laws of labor. It is believed that the practice of the three laws of labor should be effective in managing the relationship between labor and capital. This thesis tries to offer different ideas about policies and management models which can help to make proper policies to solve the problems of dispute between labor and capital by studying the laws for policies of labor and capital, the implementation of the amended three laws of labor, and the situation in which the dispute between labor and capital develops. For this purpose, the thesis analyses a particular case in Tainan City.
There are six chapters in this thesis:
Chapter1: Introduction
This chapter describes the background and the motivation of the thesis. After that, the purpose, the structures and method of the research are described. The research method includes the analysis of literature, interviews and a case study.
Chapter 2: The laws for policies of troubles between labor and capital, and literature review
This chapter focuses on the introduction and analysis of literatures of the policies which were made to solve troubles between labor and capital.
Chapter 3: Analysis of the law for troubles between labor and capital
This chapter analyses the process of the improvement of the policies for troubles
between labor and capital, comparing the possible situations before and after the amendment of the three laws of labor. This chapter also describes the contents of the three laws which deal with troubles between labor and capital.
Chapter 4: A study on management models of troubles between labor and capital
This chapter describes the situation of the relationship between labor and capital in Taiwan. The thesis also mentions possible influences from different policies and management of troubles between labor and capital in politics, economy and the society.
Chapter 5: A case study of troubles of labor and capital which happened in Tainan City
By methods of literature review, a case study and interviews, troubles between labor and capital are studied to evaluate the development of policies and legislation. The feasibility of amending policies is also discussed.
Chapter 6: Conclusion and suggestions
Regarding making laws for policies and management models for troubles between labor and capital, this chapter makes conclusions and suggests possible ways of thinking, aiming to promote better relationships between labor and capital and to develop economy.
