Summary:碩士 === 國立中興大學 === 法律學系科技法律碩士班 === 101 === Facing the impact of climate change and the increasing emission of carbon dioxide, we can find the mitigation and adaptation actions have gradually changed from the “top down” level to the “ bottom-up” level through the legislative research on foreign cities and Taiwan’s current low-carbon policies. Most of the foreign advanced cities firstly set up their mandatory emission reduction targets. The principles of the verification and the evaluation mechanisms ensure the implementation of promoting low-carbon cities. Also, these cities establish local legislation on renewable energy, low carbon buildings, low carbon transportation and the land-use control to comply the goal of sustainable development in low-carbon cities. In order to achieve these goals, these foreign cities build legal basis for the establishment of the low-carbon cities. Those regulations and legislative proposals are very detail and thoughtful in those development plannings. Therefore, the fine local legislation leads the achievements and success on those low-carbon cities. In contrast to the promotion of low-carbon city in Taiwan, although we have recognized the importance of low-carbon cities in recent years, mainly of our low carbon objectives and contents still stay in implementation of administrative measures. Without the establishment of legislation and the recognition on adaptation measures also slow down our promotions in low-carbon cities. The local policy development on low-carbon cities should have comprehended planning and be delivered to different agencies by separated missions. In addition, low-carbon cities in Taiwan haven not established their common principle of the verification and the evaluation mechanism.The local governments should also be encouraged to sign international agreements on greenhouse gas emissions reductions and climate protections. Learning these successful foreign experiences in promoting low-carbon cities, it is important to summarize and find out what kind of the policies and legislation are proper for Taiwan. We should also emphasis on the legalization of promoting low-carbon cities. It would be helpful in the development of low-carbon cities in Taiwan.
