So, the important of patent right also makes patent transaction more popular. Through patent transaction, companies can get the technology legitimately, and it saves time and reduces cost in R&D. For industry, patent transaction can make resource be used more effectively, and it reduces R&D ratio of repeat. Behavioral and Economic Experiment discusses psychology and decision-making with different experimental design, in which the ultimatum game is sender distributes the money to receiver, and depending on whether the receiver accepts or not. Using this result to understand the process of psychology and behavior between them, and this distribution concept is similar to the transaction. Therefore, this study will use the Behavioral and Economic Experiment as foundation to construct experimental condition in patent transaction. This study focuses on exclusive licensing of patent licensing, and we want to understand the decision-making in patent transaction through the result. This study hypothesizes that (1) the different quantities of sale will affect buyer’s bid, the price seller wants to accepts, the profit of buyer and seller; (2) the different number of people in transaction will affect the price of bid, sellers want to accepts, the profit of buyer and seller. This study divides the treatments into different combinations of sales and number of transaction, in order to observe the behavior in transaction. The results reveal that (1) the different quantities of sale for buyer’s bid, the price seller wants to accept, the profit of buyer and seller have no significant differences; (2) the different number of people in transaction for buyer’s bid, the price seller wants to accept, the profit of buyer and seller have significant differences. In addition, this result finds that gap between the price buyer wants to pay and seller wants to accept. That means the perceived value is inconsistent between buyer and seller, and this is match the concept of endowment effect. And the price seller wants to accept is about the half of pricing, and this is similar to the most common 50% proportion of distribution in ultimatum game.
